Defective Products

Products can be dangerous in many ways. They can be defective by design, manufacture
or failure to adequately warn. The area of the law which deals with defective products
is generally known as "product liability" law. Food and drugs can be considered
dangerous products if their warning labels are ineffective. Automobiles, farm equipment
and practically any product can be defective because of a flaw or defect in the
manufacturing process or in its initial design. Sometimes products are designed
properly and manufactured properly yet the way in which they are handled during
packaging, storage or shipment can create a dangerous environment and a risk of
injury to a consumer. For example, an orthopaedic hip replacement could be designed
an manufactured without defect; but if during the packaging or handling process
it becomes contaminated the contamination can create serious medical complications
and infection if placed by surgery into a patient.
Seat belts, air bags and tires that having a defect can cause or enhance injury
to occupants of a vehicle. Improperly manufactured toys can be a choking hazard
to children.
Sometimes products can be designed and manufactured properly, but improper maintenance
can create a hazard and injury, such as in the case of elevators or escalators.
