New Jersey Supreme Court Affirms Accutane Lawsuit

The court affirmed that a suit brought against the makers of Accutane in 2005 by a woman who claimed the drug caused her to develop ulcerative colitis is not time-barred and the statute of limitations did not prevent her from filing a claim against the manufacturer of the drug. The judgment in favor of the Plaintiff, Kamie Kendall, was affirmed, and the Supreme Court of N.J. ruled that if the warnings are presumed sufficient to place an adult consumer on reasonable notice of a drug’s risks, they bear on what the consumer reasonably should have known about potential side effects.

What is Accutane® ?

Accutane® (also known as isotretinoin) is prescribed by dermatologists as a last resort for people with severe, disfiguring acne. Accutane® is a form of vitamin A. It reduces the amount of oil released by oil glands in your skin, and helps your skin renew itself more quickly. Accutane® is manufactured by Roche Pharmaceuticals. Accutane® is also marketd under the names RoAccutane®, Amnesteem®, Clarvis®, and Soret®.

Its known side effects include increased sensitivity to sunlight and birth defects. Accutane® has been linked to Crohn's Disease, Ulcerative Colitis and Inflamatory Bowel Disease.

On June 26, 2009 Roche Holding AG, the world's biggest maker of cancer drugs, is pulling its Accutane® acne medicine from the U.S. market after juries awarded at least $33 million in damages to users who blamed the drug for bowel disease.
